Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and Blue Wonders Consultancy ("Blue Wonders", "we", "us" or "our") governing your access to and use of bluewondersconsultancy.com (the "Site"). By accessing or using the Site, you confirm that you have read, understood and agreed to these Terms. If you do not agree, please do not use the Site.

These Terms apply to public visitors of the Site. Services that we deliver to clients are separately governed by a written master services agreement and the applicable statement of work. In the event of a conflict, the services agreement controls for that engagement.

The Site is an informational website describing our consulting services. The Site is not a marketplace, financial product, gambling or betting service, or an automated data-collection platform.

You must be at least 18 years old to use the Site. By using the Site you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal or internal business purposes. You agree not to:

• use the Site in any way that violates applicable law or these Terms;
• attempt to gain unauthorised access to the Site, our systems or any related infrastructure;
• interfere with or disrupt the Site, including by introducing malware, sending automated traffic at abusive rates, or attempting to overload our servers;
• scrape, harvest, copy or reproduce material from the Site except as expressly permitted by these Terms or applicable law;
• use the Site to send unsolicited communications, fraudulent content or other harmful material; or
• misrepresent your identity, affiliation or the source of any information you submit to us.

The Site, including its text, graphics, logos, page layouts, code and underlying design, is owned by Blue Wonders or its licensors and is protected by copyright, trade-mark and other intellectual-property laws. Except for content you submit, no right or licence is granted to you other than the limited right to view the Site under these Terms.

The "Blue Wonders" name, logo and related marks are trademarks of Blue Wonders Consultancy. You may not use them without our prior written consent.

When you submit information through a contact form, request a proposal or otherwise communicate with us through the Site, you represent that the information is accurate and that you have the right to share it. You grant us a non-exclusive, worldwide, royalty-free licence to use the information for the purpose of responding to your enquiry and operating our business, in line with our Privacy Policy.

Please do not send us confidential, regulated or sensitive information through the Site. If you need to share such information, contact us first so we can agree appropriate safeguards.

The Site may contain links to third-party websites or integrations with third-party services. We do not control those sites or services and are not responsible for their content, practices or policies. Your use of any third-party site or service is at your own risk and subject to that party's terms.

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Information published on the Site is provided for general informational purposes only and does not constitute professional advice. Reliance on any information found on the Site is at your own risk; for advice tailored to your situation, please contact us.

To the maximum extent permitted by law, neither Blue Wonders nor its officers, employees, contractors or affiliates will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or in connection with your use of the Site — even if we have been advised of the possibility of such damages.

Our aggregate liability arising out of or relating to the Site will not exceed the greater of (a) the amount you have paid us for use of the Site, or (b) one hundred US dollars (US$100). Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the smallest extent permitted by law.

You agree to indemnify and hold harmless Blue Wonders and its affiliates, officers, employees and contractors from and against any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms or if continued access poses a risk to us or to other users. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, indemnification and governing law — will survive.

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws rules. The courts located in Taguig City, Metro Manila will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site, unless otherwise required by mandatory local law.

We may revise these Terms from time to time. Material changes take effect on the "Effective date" shown above. By continuing to use the Site after changes take effect, you accept the revised Terms. If you do not agree with the changes, please stop using the Site.
